General Terms and Conditions For Contests & Sweepstakes


Welcome and thank you for using this on-line service operated by Symbyoz, LLC, ("Symbyoz", "we", "our" or "us").

This page describes the general rules, terms and conditions for contests and sweepstakes organized on the Symbyoz platform.

By using Symbyoz services to create, sponsor, or participate in a contest created using the platform features, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to these terms, you should not use the Symbyoz Services to create, sponsor or participate in contests at any time. When in doubt, users must refer to the RULES FOR OPERATION OF CONTESTS AND SWEEPSTAKES from the California department of consumer affairs.


General


A contest is any game, puzzle, scheme, or plan which offers prospective participants the opportunity to receive or compete for gifts or prizes on the basis of skill.

A sweepstakes is any procedure for distributing anything of value by lot or chance. A sweepstakes must not violate any provision of law, including the law that prohibits lotteries.


The evaluation of the skills is based on the content submitted by Participants in their entries.

Participation to a contest can be conditioned wholly or partly on the payment of some value, but the contest must not include an element of chance.

A contest does not include a sporting event, performance, or tournament of skill, power or endurance between participants who are actually present.


The main differences between a sweepstakes and a contest are that the contest participants must use at least some skill to win the prize and may pay some value to participate in the contest.

No purchase or payment is necessary in order to enter a sweepstakes.


How to win


To enter a contest or sweepstake, users must submit an entry by promoting a campaign specified by the organizer.

Each contest or sweepstake can have guidelines to indicate additional specific tasks or content to produce on each entry to win.


Winners are determined based on a random draw (sweepstake), or based on an evaluation made by the organizer and sponsors (contest).


Contests and Sweepstakes are launched by the Organizer, and ends at a time he specifies.

Organizers and Sponsors should make sure that the necessary judging to finalize the contest or sweepstake is done no more than 10 business days after the end of the contest or sweepstake.


Announcement and communication of the results should be communicated by the Organizer on the Symbyoz platform or by e-mail.


Conditions and Disclaimers


If, for any reason, the contest or sweepstake is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Orgnizers and Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, then the Organizer has the right in his sole and unequivocal discretion to cancel, terminate, modify or suspend the contest or sweepstake due to any reason of a technical, creative or other nature.

Participants, Sponsors and Organizers agree that Symbyoz shall not be responsible or liable for damages or losses of any kind arising out of or resulting from entry and participation, sponsoring or organization of the contest, acceptance or use of a prize or any other matter related to this contest, including, without limitation, claims based on property damage, violation of intellectual property rights, personal injury and/or death, publicity rights, taxes or other duties, defamation or invasion of privacy or any other legal claims.

Each Sponsor, Organizer and Participant should have a valid Symbyoz account associated to a valid e-mail address for communication purposes.

Symbyoz reserves the right to take actions or ban from using Symbyoz services users who are not following the terms and rules of the contest and sweepstake services.
